These Terms & Conditions apply to your access to and use of the Soon Maternity website at www.soonmaternity.com (Website) and to all orders placed through the Website. By accessing the Website or placing an order, you agree to be bound by these Terms & Conditions. Please read them carefully before using the Website or purchasing our products, as they contain important information about your rights and obligations, our products and services, shipping, returns, refunds, and other matters relating to your purchase.

 

1. Introduction

Your use of this website is conditional upon your acceptance and compliance with our Terms and Conditions as set out below.

Soon reserves the right to amend the Terms and Conditions at any time without notice. Your continued use of the website after any amendment becomes effective constitutes your agreement to be bound by the Terms and Conditions as amended.

2. GST, Customs and Duties

GST (Goods and Services Tax) of 10% is inclusive in all our Australian prices. Prices displayed on our website will adjust to your local currency based on your location. 

For customers in the United States and select international markets, duties and taxes are included in the price at checkout (Delivered Duty Paid — DDP). This means you should not receive any unexpected duties or charges upon delivery. In rare circumstances where additional payment is required due to unforeseen logistics issues — such as a shipment being unable to transit through certain countries — we will contact you directly before any action is taken.

 

3. Payment

Prices of products, delivery, and other charges are current at the time of issue but are subject to change at any time. If stock is unavailable, a customer service representative will contact you regarding an alternative.

 

4. Shopping Security

Your security is a priority at Soon Maternity. We use SSL (Secure Sockets Layer) technology to encrypt your personal and payment information as it travels across the internet. All forms on our site are secured with SSL, meaning your credit card numbers and other personal information are always encrypted before transmission.

You can confirm you are in a secure session when “https” appears in your browser address bar and a padlock icon is displayed. Please note that some pages on our site may display “http” without a padlock — this simply means there is no form or input field on that page, so there is nothing to encrypt. Any page that asks you to enter personal or payment information will always display “https” and the padlock icon.

 

5. Shipping & Delivery

Orders have a processing time of 1–2 business days before dispatch. During peak periods, please allow additional time. In rare cases, additional postage fees may apply for international remote areas — we will contact you directly if this occurs.

Orders placed after 3:00 pm AEST will be processed the following business day. All orders are processed Monday to Friday, 10:00 am – 3:00 pm AEST.

Australia
All Australian online orders are shipped via Australia Post.
•    Standard Shipping: Free on orders over AUD $180 / AUD $10 flat rate for orders under AUD $180 / Delivery in 3–7 business days
•    Express Shipping: AUD $15 flat rate / Delivery in 2–4 business days

New Zealand
•    Standard Shipping: Free on orders over AUD $180 / AUD $15 flat rate for orders under AUD $180 / Delivery in 5–7 business days
•    Express Shipping: AUD $25 flat rate / Delivery in 2–5 business days

United States
•    Standard Shipping: Free on orders over USD $100 / USD $20 flat rate for orders under USD $100 / Delivery in 5–8 business days
•    Orders are shipped DDP (Delivered Duty Paid) — import duties and taxes are included in the price at checkout
•    Please note: duties and taxes paid on your behalf are non-refundable and will be deducted from any applicable refund

International Orders (Excluding US)
•    Standard Shipping: Free on orders over AUD $300 / AUD $20 flat rate for orders under AUD $300 / Delivery in 5–8 business days
•    Orders are shipped DDP (Delivered Duty Paid) — import duties and taxes are included in the price at checkout
•    Please note: duties and taxes paid on your behalf are non-refundable and will be deducted from any applicable refund

6. International Duties & Returns
Orders are shipped DDP (Delivered Duty Paid). Import duties and local taxes are included in the price at checkout — no additional charges will be applied upon delivery.

If a shipment is refused or returned to sender, the following will apply:
•    Original shipping fees are non-refundable, including any paid upgrades
•    Return-to-Sender (RTS) fees, a 20% restocking fee, and any additional carrier or customs handling charges will be deducted from the final refund or credit
•    Any delays, losses, or extra charges arising from a customer’s refusal to pay duties or accept a shipment are not the responsibility of Soon Maternity

To comply with Australian export regulations, we are required to declare the exact value of all items and mark them as dutiable merchandise. We are prohibited by law from marking orders as gifts.

7. Returns & Exchanges
How to Return an Item
Returns and exchanges are managed through our self-serve returns portal. To start a return or exchange:
•    Visit our returns portal and enter your order number or the email address used at checkout
•    Select the item(s) you would like to return
•    Choose your preferred resolution — refund, exchange, or store credit
•    If you purchased Checkout+, your free prepaid return label will be generated automatically. Without Checkout+, return postage is at your cost
•    Drop off your package at the designated carrier location

Melbourne customers: You may return your online order directly to our South Yarra boutique (481 Malvern Rd, South Yarra VIC 3141) — no return postage required.

Returns Policy
To be eligible for a return, the following conditions must be met:
•    Returns must be requested within 14 days of receiving your delivery. Requests outside this window cannot be accepted
•    Items must be unworn, unwashed, and in new condition with all original Soon Maternity tags still attached

Return eligibility by item type:
•    Full-price items: Eligible for a refund, exchange, or store credit
•    Sale items: Eligible for exchange or store credit only — no refund
•    Final Sale items: Not eligible for return, exchange, or store credit. Final Sale items are clearly marked in the product description — please check before purchasing
•    Soon Beauty products: Cannot be returned unless received damaged. If you believe your item is damaged, contact info@soonmaternity.com with a photo and we will take care of it

Sale event restrictions: Items purchased during sale events (including but not limited to the EOFY Sale, Black Friday, and Boxing Day Sales) are eligible for exchanges and store credit notes only and are not eligible for a refund, unless otherwise stated at the time of the sale.

Checkout+ — Free Returns & Shipping Protection
Checkout+ is available at checkout for $4.95 AUD. It includes:
•    A free prepaid return label for all items in your order
•    Shipping protection on your entire order
Without Checkout+, return postage is at your cost. You can still use the returns portal to lodge your return and select your preferred carrier.

Please note: the free prepaid return label is available to Australian, New Zealand, and US customers only. Customers in all other countries are not eligible for the prepaid label but can still use the returns portal to lodge a return, select their preferred carrier, and arrange and pay for their own return postage.

Exchanges
Exchanges are currently available for customers in Australia, New Zealand and the United States only.
Exchange shipping costs vary by region:
•    Australia: Soon Maternity covers the shipping cost for your first exchange. Any additional exchanges are at your expense.
•    New Zealand: A flat rate of AUD $10 is charged at the time of exchange.
•    United States: A flat rate of USD $20 is charged at the time of exchange to send your replacement item.

Customers outside Australia, New Zealand and the United States are not eligible for exchanges. If you require a different size, colour or style, you will need to return your item in accordance with our Returns Policy (where eligible) and place a new order through our website.

Faulty Items
If you receive a faulty item, lodge a claim directly through our returns portal — no need to contact us first.
•    Visit the returns portal and enter your order number and email address
•    Select “Faulty item”, upload clear photos, and describe the issue
•    Our team will review your claim and be in touch within 3–5 business days

Important: If you notice anything that appears faulty — including minor issues such as a small mark or stain — please do not wash, wear, or remove the tags from the item before contacting us. We are unable to assess or accept faulty claims for items that have been washed, worn, or had their tags removed, as this prevents our quality assurance team from properly inspecting the issue. Please contact us first and keep the item in its original condition until your claim has been reviewed.

Items will be inspected by our quality assurance team. If confirmed faulty due to manufacturing or materials, Soon Maternity will replace or refund the item at no additional freight cost. If the item is not deemed faulty, it will not qualify for a return or exchange.

Incorrect Item Sent
If you receive the wrong item, lodge a claim through our returns portal — no need to contact us first.
•    Visit the returns portal and enter your order number and email address
•    Select “Wrong item received” and upload clear photos
•    Our team will be in touch within 3–5 business days
Colour Disclaimer
As colours shown on screen may not exactly match physical goods, the colour shown on our website is for illustrative purposes only and is not grounds for a return.

 

8. EU & UK Right of Withdrawal

Customers in the European Union and the United Kingdom have a statutory right to withdraw from many contracts within 14 days of receiving their order, without providing any reason.

This right is provided under:
•    EU customers: the EU Consumer Rights Directive (Directive 2011/83/EU), in effect since 13 June 2014
•    UK customers: the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, also in effect since 13 June 2014 and retained as UK domestic law following Brexit

To exercise your right of withdrawal, please initiate the process through our returns portal. Customers are responsible for the cost of returning goods when exercising the right of withdrawal. Where we provide a prepaid return label, the cost of that label will be deducted from your refund.

We will process your refund without undue delay and no later than 14 days after we receive the returned goods, or after you provide satisfactory evidence that the goods have been returned, whichever occurs first.

This right applies to all eligible items purchased through our store, except where a statutory exemption applies (see below). The EU and UK Right of Withdrawal overrides our standard sale and final sale return restrictions. EU and UK customers are entitled to a full refund regardless of whether the item was purchased at full price, on sale, or marked as final sale. Please note that no restocking fee will be applied to returns made under this right.

Customers may inspect and try on garments to the extent that would reasonably be permitted in a retail store. However, if an item has been worn beyond what is necessary to assess its nature, characteristics and fit, we may make a deduction from the refund to reflect any diminished value.

This right does not apply to certain exceptions such as digital products, perishable goods, sealed personal hygiene products, and personalised items, as set out in Article 16 of Directive 2011/83/EU and the equivalent UK regulations.

 

9. Sale & Promotional Terms

Sale offers are valid for a limited time only. Offers exclude gift cards and cannot be used in conjunction with any other offer, discount code, promotion, or bundle offer unless otherwise stated. Offers are strictly not valid on previous purchases or orders already placed. Discounts are applied at checkout with the relevant code.

Sign-up discount codes require a minimum spend of AUD $100 to be applied at checkout.

Items purchased during sale events (including but not limited to the EOFY Sale, Black Friday, and Boxing Day Sales) are eligible for exchanges and store credit notes only and are not eligible for a refund. Final Sale items (clearly marked in the product description) are not eligible for return, exchange, or store credit. Please check the product description carefully before purchasing.

Exception — EU & UK customers: If you are located in the European Union or the United Kingdom, your statutory right of withdrawal under the EU Consumer Rights Directive or the UK Consumer Contracts Regulations 2013 applies to all purchases, including those made during sale events or marked as Final Sale. Please refer to Section 8 for full details.

10. Gift Cards
Gift cards are offered in store or via the website. The amount on each gift card will expire on the date shown and cannot be exchanged or redeemed for cash or used in any retail store. Gift cards cannot be replaced if misplaced. Gift cards are excluded from all promotions and discount offers.

11. Stock & Pricing Errors
While we make every effort to ensure that all product information and pricing displayed on our website is accurate, errors may occasionally occur. Soon Maternity reserves the right to cancel or refuse any order placed at an incorrectly listed price due to a website error. If this occurs, we will notify you as soon as possible and issue a full refund of any payment made.

If stock becomes unavailable after your order has been placed, a customer service representative will contact you to discuss an alternative or arrange a full refund.

12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any disputes arising out of or in connection with these Terms and Conditions.
Nothing in this clause affects any statutory rights you may have under the laws of your country of residence. In particular, customers located in the European Union or the United Kingdom retain all rights afforded to them under applicable EU and UK consumer protection legislation, including but not limited to the EU Consumer Rights Directive and the UK Consumer Contracts Regulations 2013.

13. Limitation of Liability
To the fullest extent permitted by law, Soon Maternity shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of this website or any products purchased through it. This includes but is not limited to website downtime, errors in product descriptions, delays caused by third-party carriers, or circumstances outside our reasonable control (including natural disasters, strikes, or supply chain disruptions).

Nothing in this clause limits or excludes any liability that cannot be excluded under the Australian Consumer Law or any other applicable legislation, including any consumer guarantees or statutory rights you may have.

14. Your Privacy
At Soon we value your privacy. Under the Privacy Act 1988 and the Australian Privacy Principles, any personal information we collect will be kept securely. We do not require consumers to disclose personal information to browse our website and only collect the minimum information necessary to process a purchase.

We will treat personal information as strictly confidential and will not disclose, sell, or share it with third parties without your prior express consent, except as required by law.
When you register on the Soon website, you are automatically added to our mailing list. To unsubscribe, email info@soonmaternity.com or follow the unsubscribe link on any newsletter.

15. Automatic Data Collection
Certain information is transmitted to us automatically due to the nature of the internet, such as your IP address and browser type. This information is collected for statistical purposes only. We do not attach any personal information to these statistics, and this information is not stored.
